These Terms and Conditions (“Terms”) constitute a legally binding agreement between the client (“Client,” “You,” or “Your”) and My Homecare & Services (“Company,” “We,” “Us,” or “Our”).

By requesting, booking, purchasing, enrolling in, or receiving services from My Homecare & Services, You acknowledge that You have read, understood, and agree to be bound by these Terms in full.

1. Nature of Services

My Homecare & Services provides non-medical, non-clinical support services intended to assist individuals with daily living activities, companionship, and household support. Services are designed to promote comfort, dignity, independence, and safety.

Services may be provided in private residences, assisted living communities, hospitals, or other authorized care facilities.

All services are subject to suitability, safety considerations, staffing availability, operational feasibility, and Company acceptance. The Company reserves the right to decline, modify, or discontinue services where safety, scope, or operational limitations exist.

2. Non-Medical Services Disclaimer

My Homecare & Services provides strictly non-medical support services.

The Company does not provide:

  • Medical diagnosis or assessment

  • Clinical or therapeutic treatment

  • Medication administration or management

  • Nursing, rehabilitation, or medical supervision

Caregivers do not replace licensed healthcare professionals and do not provide services requiring medical judgment.

Clients remain solely responsible for:

  • Medical conditions and healthcare decisions

  • Medications, treatments, and monitoring

  • Obtaining appropriate professional healthcare services

Any assistance that may appear medical in nature is provided only as practical, non-medical support and does not constitute healthcare.

3. Categories of Services & Service Hours

Homecare (3.1), Staffing Services (3.2), General Support Services (3.3), Shared Support Services (3.4)

3.1 Homecare — Seniors & Individuals with Special Needs

Homecare services are generally provided during the following time blocks, subject to availability and scheduling confirmation:

Monday — Sunday
Daytime Care: 7:00 a.m. – 5:00 p.m.
Evening Care: 5:00 p.m. – 10:00 p.m.

Overnight Care:

  • 10:00 p.m. – 6:00 a.m.

  • 12:00 a.m. – 8:00 a.m.

  • 8:00 p.m. – 8:00 a.m.

Overnight services may be provided on an 8-hour or 12-hour flat-rate basis, as outlined in the Fee Schedule.

Scope of Homecare Services

Services may include:

  • Personal care and hygiene assistance

  • Dressing and grooming assistance

  • Toileting and incontinence support

  • Feeding assistance as outlined in the care plan

  • Transferring and mobility assistance

  • Companionship and social engagement

  • Light meal preparation

  • Light housekeeping

  • Respite care for family caregivers

  • Non-medical palliative and comfort support

Homecare services require completion of a Homecare Intake Form and Company approval.

3.2 Staffing Services

Staffing Services are specifically designed for hospitals, care homes, nursing homes, and other institutional organizations.

  • Services do not apply to individual in-home care clients

  • Standard administration fees do not apply

  • Services are billed according to the organizational agreement

  • Staffing services provide trained caregivers for institutional needs, subject to Company approval and availability

3.3 General Support Services and Service Hours

General Support Services are generally available during the following hours:

Monday — Saturday
8:00 a.m. – 8:00 p.m.

Service availability remains subject to staffing, scheduling, and operational capacity.

Scope of General Support Services

Services may include:

  • Residential cleaning and light housekeeping

  • Basic meal preparation using client-provided groceries

  • Walking companionship

These services do not include personal care, feeding assistance, medication support, or medical services.

3.4 Shared Support Services

Service Purpose

Shared Support Services provide non-medical, on-site support for residents — Assisted Living, Independent Living & Supportive Residential Settings — who are generally independent but may benefit from added supervision, reassurance, and brief task-based assistance throughout the day.

This service supplements, but does not replace, personal homecare services, facility staff responsibilities, or emergency response systems.

Service Model & How It Works

  • One My Homecare & Services caregiver is present on-site during scheduled service hours

  • Support is shared among enrolled residents only

  • Assistance is provided in short, task-based intervals

  • Services are delivered based on urgency, availability, and caregiver discretion

  • Services are not scheduled at exact times

  • Individual service time is not guaranteed

Shared Support Services are not:

  • Continuous supervision

  • Emergency response services

  • A replacement for individual homecare aides

  • A guarantee of individualized or extended care

Shared Support Service Hours

Shared Support Services are generally provided between:
7:00 a.m. – 3:00 p.m. (Monday — Sunday)

Hours may be adjusted based on enrollment levels, facility coordination, or operational needs.

Scope of Assistance

All Shared Support Services are non-medical and may include:

  • Mobility assistance (walking support, wheelchair assistance)

  • Help retrieving items or completing brief daily tasks

  • Meal support (set-up, encouragement, or assistance as permitted)

  • Companionship, reassurance, and routine check-ins

  • Prompt response to minor, immediate needs

Limited Personal Care Support

Light assistance with toileting or bathing may be provided only when:

  • The resident is capable of performing the task independently

  • Assistance is limited to cueing, reassurance, standby support, or minimal hands-on help

  • The task falls within the caregiver’s scope, training, and professional discretion

Eligibility & Enrollment

Participation requires:

  • Minimum resident enrollment to meet operational feasibility

  • Completion of a Shared Support Service Agreement

  • Completion of a basic care needs profile

  • Company approval

Services are provided only to enrolled residents. My Homecare & Services may modify, suspend, or discontinue Shared Support Services if enrollment thresholds are not met.

Fees & Participation

  • Shared Support Services are provided on a daily shared-access basis, not hourly care

  • A $50 non-refundable registration fee applies and is credited toward service participation

  • Daily participation fees apply regardless of actual usage

  • Fees are tiered based on the number of enrolled residents

  • Individual caregiver availability per resident may vary

  • Two (2) weeks’ written notice is required to discontinue participation

Important Limitations

Shared Support Services:

  • Are non-medical

  • Do not include nursing or medication administration

  • Do not provide continuous supervision

  • Do not replace emergency response systems

  • Do not replace personal homecare services

In emergencies, caregivers will notify facility staff immediately and follow established emergency procedures. Caregivers are not emergency responders.

4. Transportation, Escort & Errand Services

Non-medical escort and errand services may include shopping, appointment accompaniment, and social outings.

Mileage and transportation fees apply as outlined in the Fee Schedule. Clients are responsible for parking fees, tolls, and admission costs.

5. Client Responsibilities

Clients agree to provide accurate information, maintain a safe environment, supply required items, and be present at scheduled times. Failure to meet responsibilities may result in suspension or termination of services without refund.

6. Client Acknowledgement & Assumption of Risk

Clients acknowledge inherent risks associated with in-home and shared support services and voluntarily assume such risks to the fullest extent permitted by law.

7. Limitation of Liability

Liability is limited to direct damages resulting from proven failure to exercise reasonable care. No limitation applies to gross negligence or willful misconduct.

8. Client Conduct & Safety

Unsafe, abusive, or inappropriate behavior may result in immediate service termination without refund.

9. Privacy & Confidentiality

Client information is handled in accordance with applicable privacy laws and used only for legitimate service and administrative purposes.

10. Fees, Payments & Scheduling

Fees, payment terms, cancellations, refunds, and late charges are governed by the current Fee Schedule.

11. Hospitals & Care Facilities

Written authorization and compliance with facility policies are required.

12. Children & Pets

My Homecare & Services does not provide care, supervision, or monitoring of children or pets.

For safety reasons, children and pets must be supervised, secured, or placed in a separate area of the home during service visits unless otherwise approved in advance. Clients remain fully responsible for the care, supervision, and control of children and pets at all times.

13. Service Area

Services are primarily provided in Winnipeg, Manitoba, and surrounding areas.

14. Changes to Terms

Terms may be updated at any time. Continued use of services constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Province of Manitoba.

16. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

17. Acceptance of Terms

By booking or receiving services, You agree to these Terms in full.
